New Jersey's Newest Lead Paint Law
It’s here! New Jersey’s latest lead-based paint law is now in effect, directly targeting ALL pre-1978 rental properties. Known as New Jersey’s Lead Safe Certification, this law mandates lead-paint inspections (visual and/or dust wipe) for all non-exempt rental properties at tenant turnover.

Lead Inspection Requirements

Mandatory Inspections
Lead inspections are required every three years or at tenant turnover for pre-1978 rental properties to ensure compliance.
Lead Assumption Rule
If a pre-1978 property has never been tested, it is automatically presumed to contain lead-based paint hazards.
Legal Compliance
Following inspection requirements helps landlords avoid costly penalties, legal issues, and mandatory lead hazard correction expenses.

Visual Lead Safe Certificate

A Dust Wipe Testing Certificate verifies a property’s lead safety through lab analysis. A certified inspector conducts a visual check and collects dust wipe samples from various surfaces. If lab results meet safety standards, a two-year certification is issued.

Understanding Lead-Safe vs.
Lead-Free Certification

Lead Safe Certification (Valid for Up to 2 Years)
A temporary certification that verifies no immediate lead hazards exist, ensuring compliance with safety regulations. Required at tenant turnover, it helps prevent lead exposure risks, protects occupants’ health, and ensures landlords meet legal requirements for maintaining a safe living environment.
- Visual Inspection: Examines surfaces to confirm no chipping, peeling, or deteriorating lead-based paint hazards.
- Dust Wipe Exam: Collects and analyzes dust samples in a certified lab to ensure lead levels are within safe limits.
Lead Free Certification (Valid for a Lifetime!)
A permanent certification that confirms the property is entirely free of lead-based paint, ensuring long-term safety. This eliminates the need for future lead inspections, compliance checks, and potential hazards, providing property owners with peace of mind and regulatory assurance.
- Certified Lead Risk Assessor (LRA): Licensed professionals conduct lead assessments following strict regulatory guidelines.
- X-Ray Fluorescence (XRF) Analyzer: Uses advanced technology to detect and confirm the complete absence of lead.
